Land Trusts and Revocable Living Trusts discussion with Marty and David

For 2009, David Corbaley and I will pick a topic every Friday and talk about it for 15-20 minutes. We’ll record the conversation and upload it for you. Please feel free to add a comment or two (upper right of this page) if you choose.

For today’s topic, we’re discussing Land Trusts, the pros and cons of them, and how they can be correctly used with real estate transactions (and flips!). Who do you recommend as an attorney in the state of washington who knows what he is doing when it comes to land trusts? Any what title company would you recommend?

I used to use Russ Cofano. An excellent RE attorney. Unfortunately, he went to work exclusively for a real estate company and is no longer available for private practice. Afraid I can’t help you there.
We use Talon title. They understand our business, and are good to work with. They have great tools for their clients as well.

Hey guys,

What method do you recommend using in Oregon. The local title and escrow don’t want to touch deals held in trust if it’s a short sale. We have very close relationships with several title companies and insurance underwriters and they all say the same thing….”we won’t insure a trust transaction on a short sale.”

Is using a revocable living trust going to solve this issue, or not?

All our offers are coming in FHA so we drastically need to solve this issue.
